Without Prejudice

Gents,

Finally sorted!

After ordering some stainless steel header for my sumo from ShinyBitz last March I finally have resolution.

I chased the items for 6 months + after paying in full having been told the items were 1 week away from dispatch. Needless to say items never arrived and I was given reason after reason as to why they were not quite ready.

Come the end of summer I sent Mr Williamson a recorded delivery letter requesting my parts in 14 days or I shall be starting legal proceedings.

After several weeks Roger returned my monies less £100+ deposit. I issued court proceeding for the return of my deposit via money claims online (a finally useful government website!).

Various submissions to court prevailed.......

A few more submissions to court prevailed.....

You get the picture......

2 weeks ago after the case was transferred to Nottingham county court I finally got a conclusion. After Roger requested to have the case transferred to his local court so he could submit his defence in person and after me travelling 220 miles to attend he did not show up.

His defence was immediately quashed. He was ordered to pay all costs including my travel, loss of earnings and a previous bailiff expenses that had been sent to his premise but were unable to make contact with him.

For the sake of £100+ he now is liable for a several times this amount, plus interest if he does not pay.

I doubt I will ever see my money back but that is not the point. If people are allow to request monies for products they never deliver without any consequences, they are no different to someone who burgles you.

By now, there have been enough posts regarding Roger to ensure anyone viewing the forum enters into business dealing with him fully informed. It just feels great to finally be able to air my side of events.

Ironically, having failed to be delivered the items I ordered I reverted to the Pilgrim supplied items. This led me sourcing some side pipes from a fellow CRC member who had just replaced his standard items with a full system supplied by ShinyBitz. He was very happy with them and I have to say they did look good...... go figure!

Will you be sending the baliffs into collect good to the value- further adding to his costs ? I'm sure his welding equipment qould be high on their list of items to take.

I am still thinking about what it must be like to drive a Cobra around
Eastbourne (my home town btw).

One blip of the throttle must cause several Rover-Metro-driving old ladies to die of shock!

Oh and yes - send the bailiffs around not to his workshop, but to his house, They will put a clamp on his car(s) untill he pays up!

Brian. If your supplier of S/H Sidepipes was who I thought it was? He got Rogered later with the lose of a £500 deposit on a Paint Job Again won in court.

Wilf its just down the road from me, and yes I have been through the town a few times in the cob. He He
